SHORE Smart Home Terms & Conditions of Sale and Installation
These Terms & Conditions describe general policies that apply to products and services provided by Shore Sound & Cinema, LLC d/b/a SHORE Smart Home (“SHORE Smart Home,” “SHORE,” “we,” or “us”).
Individual projects may also be governed by a written proposal, contract, change order, service agreement, invoice, or other documentation issued by SHORE Smart Home. In the event of a conflict, the terms of the applicable signed agreement or other project-specific written documentation shall control.
Our Role
SHORE Smart Home is a custom technology integrator providing system design, equipment procurement, installation, programming, commissioning, client education, and ongoing support.
Many of the products incorporated into our systems are manufactured by independent third-party manufacturers. SHORE Smart Home selects, specifies, integrates, installs, and supports these products as part of the overall system but does not manufacture them.
Proposals, System Design & Client Approval
Proposals are prepared based upon the architectural plans, specifications, site conditions, client selections, design information, and other materials available to SHORE Smart Home at the time the proposal is prepared.
Equipment quantities, device locations, finishes, system requirements, labor, and other elements of the project may change as the project develops.
Client approval of a proposal authorizes SHORE Smart Home to proceed in accordance with the approved scope and applicable project agreement.
Changes to architectural plans, interior design, electrical plans, cabinetry, millwork, landscaping, construction conditions, client selections, or work performed by other trades may require revisions to the system design, equipment, labor, pricing, or project schedule.
Allowances & Preliminary Quantities
Certain proposals may include equipment quantities, device counts, allowances, or system components based upon preliminary plans or information available at the time of proposal.
Final quantities may change as engineering, construction, field conditions, electrical load schedules, lighting plans, reflected ceiling plans, furniture plans, landscape plans, or other project details are finalized.
Any resulting additions, deletions, or revisions may be addressed through an updated proposal or change order.
Custom, Special-Order & Configured Products
Many products supplied by SHORE Smart Home are custom, special-order, made-to-order, engraved, programmed, configured, fabricated, or otherwise prepared specifically for an individual project.
These may include, without limitation, custom keypads and engraving, motorized shades and drapery, custom-finished speakers, specialty architectural products, fabricated mounting solutions, custom displays, specialty lighting products, racks, panels, and other project-specific equipment.
Once an order has been placed or accepted by the manufacturer, distributor, or fabricator, custom and special-order products may be non-cancelable and non-returnable except where required by applicable law or permitted by the manufacturer.
Product Availability, Substitutions & Manufacturer Changes
Product availability, specifications, finishes, lead times, model numbers, software features, and pricing may change without notice due to manufacturer or distributor actions.
If a specified product becomes unavailable, discontinued, delayed, or materially changed, SHORE Smart Home may recommend an alternative product of comparable or better performance, subject to client approval where appropriate.
Manufacturer Lead Times & Project Scheduling
Estimated manufacturer lead times, shipping dates, production schedules, and delivery dates are estimates and may change.
SHORE Smart Home cannot control manufacturer backorders, production delays, carrier delays, supply-chain disruptions, or other circumstances outside our reasonable control.
Project scheduling may also depend upon site access, completion of work by other trades, electrical power, internet service, cabinetry, finished surfaces, construction progress, and other conditions necessary for our work.
Site Readiness & Coordination With Other Trades
SHORE Smart Home works in coordination with builders, architects, interior designers, electricians, HVAC contractors, landscape professionals, cabinetmakers, millworkers, security contractors, internet service providers, and other project participants.
SHORE Smart Home is not responsible for delays, additional labor, equipment changes, or other costs resulting from incomplete work, inaccurate information, inaccessible work areas, changes made by others, or site conditions that differ from the information provided during system design.
Return visits or additional labor resulting from a site not being ready for scheduled work may be billed separately where appropriate.
Existing Wiring, Equipment & Infrastructure
On renovation, service, takeover, and retrofit projects, SHORE Smart Home may encounter existing wiring, equipment, programming, networks, infrastructure, construction conditions, or concealed conditions that cannot reasonably be evaluated before work begins.
Existing systems may contain undocumented wiring, hidden damage, obsolete equipment, unsupported software, improper installation, network deficiencies, incompatible products, or work performed by others.
Any additional work required to identify, correct, replace, repair, or accommodate these conditions may be outside the original scope and subject to additional charges.
Client-Supplied & Third-Party Equipment
SHORE Smart Home may install or integrate equipment supplied by a client or another party when agreed upon in advance.
SHORE Smart Home cannot guarantee the compatibility, condition, performance, warranty status, or continued support of products that we did not supply.
Additional labor required to troubleshoot, configure, adapt, replace, or support client-supplied equipment may be billed separately.
Internet, Networks & Third-Party Services
Many modern technology systems rely upon internet connectivity, local networks, manufacturer cloud services, subscription services, applications, third-party APIs, streaming platforms, software, and other services not owned or controlled by SHORE Smart Home.
The availability, functionality, compatibility, pricing, terms, or features of these services may change over time.
SHORE Smart Home is not responsible for outages, service interruptions, changes in third-party services, discontinued integrations, manufacturer cloud availability, internet service provider performance, or other conditions outside SHORE Smart Home’s reasonable control.
Software, Firmware & System Updates
Technology products may receive software, firmware, operating-system, application, security, or cloud-service updates after installation.
Such updates may add, modify, limit, or discontinue features or integrations.
SHORE Smart Home may recommend updates, replacement equipment, reprogramming, or other system modifications when necessary to maintain functionality or compatibility. Work performed after the applicable warranty or service coverage period may be billable.
Delivery, Storage & Construction Delays
Equipment may be ordered, received, staged, programmed, or stored before the project site is ready for installation.
Where construction delays or other circumstances require SHORE Smart Home to store completed or received equipment for an extended period, additional storage, handling, delivery, or remobilization charges may apply.
Payment obligations are not automatically postponed because the project site is not ready to receive equipment unless otherwise agreed in writing.
Returns & Restocking
Return eligibility depends upon the product, condition, packaging, manufacturer or distributor policy, and whether the product has been opened, configured, registered, installed, programmed, engraved, fabricated, or otherwise prepared specifically for the project.
Approved returns may be subject to manufacturer, distributor, shipping, handling, or restocking charges.
Custom, special-order, made-to-order, configured, and personalized products may not be returnable.
Product Warranties
Products supplied by SHORE Smart Home may be covered by warranties provided by their respective manufacturers.
Manufacturer warranty terms, duration, eligibility, repair or replacement procedures, exclusions, and remedies are determined by the applicable manufacturer.
SHORE Smart Home will assist clients with manufacturer warranty matters as appropriate but does not control manufacturer warranty determinations.
SHORE Smart Home Workmanship & Installation
SHORE Smart Home stands behind the professional installation, programming, and integration services we provide in accordance with the applicable written agreement.
Applicable workmanship or installation warranty periods, exclusions, and remedies are governed by the client’s agreement, proposal, invoice, service agreement, or other written project documentation.
Service, Support & SMART-Care
Warranty coverage and ongoing technical support are separate services.
Remote support, system monitoring, after-hours assistance, software maintenance, priority scheduling, service visits, preventative maintenance, and other ongoing support services may be subject to a SMART-Care plan or other applicable service agreement.
Coverage, response times, exclusions, pricing, and benefits are governed by the applicable service documentation.
Changes & Change Orders
Changes requested by the client or necessitated by field conditions, revised plans, selections, product availability, work by others, or other project developments may affect equipment, labor, programming, system design, pricing, and schedule.
Material changes to the contracted scope may require written approval through a revised proposal or change order before work proceeds.
Payments
Payment terms are established by the applicable proposal, agreement, invoice, or other written project documentation.
Orders, installation, programming, delivery, service, or release of equipment may be contingent upon receipt of payments when due.
Past-due balances may be subject to applicable finance charges, collection costs, suspension of work, or other remedies provided by the applicable agreement or law.
Cancellations
Cancellation rights and obligations are governed by the applicable signed agreement and applicable law.
Nothing in these Terms & Conditions is intended to limit any cancellation or other consumer right provided by law.
Photography & Project Documentation
SHORE Smart Home may photograph or document system installations for internal project records, service documentation, training, manufacturer coordination, or other legitimate business purposes.
Use of client project photography for marketing, advertising, publication, or social media will be subject to applicable permissions, agreements, and privacy considerations.
Limitation & Relationship to Project Documents
These Terms & Conditions are intended to supplement the applicable written documentation issued by SHORE Smart Home.
Individual projects may be subject to additional or different terms contained in a proposal, contract, change order, service agreement, invoice, or other written document.
Where an applicable signed project agreement conflicts with these Terms & Conditions, the signed agreement shall control.
Updates to These Terms
SHORE Smart Home may update these Terms & Conditions periodically.
The version applicable to a particular project will be determined by the applicable agreement or other written project documentation.
